First-Degree Forcible Rape in North Carolina
A person can be charged with first-degree forcible rape if he engages in vaginal intercourse with a victim who is under the age of 13. The defendant must be at least four years older than the victim in order for these charges to be filed.
A person could also be charged with first-degree forcible rape if, in the commission of having non-consensual vaginal intercourse, he:
- Used force
- Used or wielded a dangerous or deadly weapon
- Inflicted serious personal injury
- Was aided and abetted by one or more other people
First-degree forcible rape is a Class B1 felony. If the victim was 13 years old or younger or if the defendant has one or more prior Class B1 felony convictions, he will be sentenced to life in prison without the possibility of parole.
